Our sons multiple stabbing is not attempted murder in California: 5x stabbed in a small business in the evening. He lived. After two major surgeries his is now recovering. I was shocked when the Stockton city attorney's office advised me the crime was "attack with force - with a personal weapon" I was shocked. I live in MA. Here if a person stabs someone 5 times it is attempted murder. I called the CA governor's office in an attempt to advise them of the issue. The staffer was aggravated with my attempt to let Arnold know there is a major flaw in their laws. If a person stabs her family member several times it is not attempted murder. She seemed unconcerned - as though I interrupted her coffee break.

Welcome to California...where illegal aliens and other criminals have more rights than law-abiding citizens.

You can take this case to the governor if you want, but you might have more luck pushing the case with the local AG.

Personally, I'd push for assault with intent to commit mayhem if the AG stands firm on no charge for attempted murder. (Besides, attempt to commit mayhem carries a heavier penalty in most states.)

I am relieved to read your son is recovering, and feel terrible for what he and your son went through.

That sure sounds like attempted murder to me! The prosecutor could be going after a lesser charge for lots of reasons. Maybe they think the effort and resources going for attempted murder would be too much, perhaps their caseload is overwhelming and they need to prioritize. Sounds awful but sometimes that's the situation. Or maybe they think the standard of evidence for attempted murder would be too difficult to prove, putting the case at risk.

I like your idea about contacting people to see what you can do, AG or governor. Hope you get some good advice and get a good result.

Thank you for the kind words.

Unfortunatly, the situation will continue if people do not take action.

Think of the children who are victims. It is time to save the people - more attention is given to animals and trees. How does this make sense?
