I agree we couldn't get away with it. As far as I know, if an enemy combatant is not wearing a uniform, then they are not protected by the Geneva Convention. No rules apply, and they may be summarily executed.

I could be wrong, but everyone at Guantanamo and Abu Ghraib could have been shot upon capture. And if we started doing that ("Because we could"), the world's outrage would be deafening -- yet we would not be violating international law.
