It sounds like some of those procedural rules in federal criminal courts, doesn't it? Where they want people to do things which would only be related to sentencing--but before there's even been a trial or a plea.
I think you were right on when you said or implied it was an OPTION.
IOW, it was an option, and Geragos decided against that option, and is pretending that he is being heroic and daring, when in fact he is losing nothing by declining the option for now.

Geragos keeps complaining that if the jury is "Witherspooned" (named after key case)--that is, if it is carefully ascertained that each one of them COULD in all conscience recommend the death penalty if deserved--he keeps complaining that this SETTLED HABIT OF COURTS is prejudicial to his client. He complains, essentially, that if it is for sure that NONE of the jurors is an anti-death-penalty fanatic/activist, then they must be all likely to be unfair to his client.
This is utter bullsh*t.
I'm sick of hearing him go on about this. Essentially, he is grandstanding in order to make conscientious objection to the death penalty into a legal issue in this case, to make politics a basis for appeal. Typical of a Clintonista to try to confuse political/ideological points with practical points. That's how the Clintonista type likes to confuse the public--or jurors.

Well Dev I think he picked the WRONG Judge to pull this crap with. Delucchi is NOT going to establish precedent on his whining. The guy KNOWS his client is toast. AND he knows that once they see the autopsy photos they will vote for death, no problem.!! He isn't even behaving like an adult anymore. His crap is childish and annoying. And like nobody sees through it??? Give us a break!!
