Woman wins €8,000 award following fall in hotel toilet

AN "INCOHERENT" woman who allegedly had to be "oxtered" to the loo at a birthday bash in a Dublin hotel has been awarded almost €8,000 damages for injuries sustained in a fall.

Circuit Court President, Mr Justice Esmond Smyth, heard that Marie Currie (53), of Ravensdale Road, East Wall, Dublin, slipped and fell in a toilet at Wynne's Hotel, during a 50th birthday party for a friend's husband.

Currie told her counsel, Hugh O'Keeffe, she had slipped in a "sea of water" on tiles and had struck her face against a panel underneath a sink.

Lily Gibson, who had organised the party, said she was wearing trousers on the night in question and had to hoist them up to avoid the bottoms getting soaked when she went to the toilet.

Mary Sweetman, who said she helped Currie following the fall, told the court the plaintiff "had drink taken but was not drunk". She said everyone was merry and that the toilets were mucky wet.

The party bar manager on the night told the court he had seen Currie being "oxtered" by two other women along a corridor towards the ladies' toilet.

Shortly afterwards, he heard a thump in the corridor and assumed she had fallen there.

He later brought her ice for a swelling on her face. She was incoherent. Later when he inspected the toilets the tiles were dry but there was a damp patch on the carpet in the lobby of the toilets.

Judge Smyth, awarding Ms Currie €7,969 damages, said he had been swayed by the fact that the hotel management had failed to produce a written record of cleaning checks which it claimed to have made on the toilets on the night of the party.

Are these factoids mutually exclusive or interdependent?
