This thread serves as a place for posting all new general information and references, along with links following Terri's case, plus information on cable news and talk radio shows dealing with the issue, court cases and press releases. This is also the place to post contact information, prayers and general discussion.

If you have something that qualifies as BREAKING NEWS or FRONT PAGE NEWS, please post it on a separate thread in that category in order to give it maximum exposure and then post a link to the article/thread here so that it will be included in the next update of links. Also, if you post links to articles from original sources and there is also a thread on FR, please link to the FR thread. Many original links become corrupt over time and we want to be able to access the information at will.

This thread will stay up through next Sunday. I will be in Kentucky for Thanksgiving, but I will still be able to check in with y'all, just not as often.

Let me tell you, I've been in FL for 12 yrs now and I absolutely can't believe that the FL Supremes were reelected after the 2000 election fiasco, but they were. I think there is a lot of 'ignorance' about what is going on and a lot of apathy. It will take a lot of work (emails, phone calls, etc) to make sure that people remember the situation and don't reelect these crumbs....

I think the media would have a hard time running very far with this character assassination of the Schindlers. It wouldn't be easy for them to reasonably explain how the Schindlers have spent themselves into bankruptcy (including their retirement accounts) just to try to keep MS from killing their daughter over the past 10 years, and have anyone believe it was over a $10,000 dispute about expenses. But, with Felos controlling so much media spin, I could sure be wrong.

If Greer had quashed the depo, it would have been done anyway. Maybe in a media forum. Who knows.

Here's my view, as a Floridan.
This case never should have reached this stage. We had complete faith in our legal system, and elected and appointed officials in deciding the right way according to laws on the books. The entire county has failed. They have failed Terri and placed her life in danger. They have failed the citizens in this state.

He has 30 days to file his report.
Hopefully, he is doing that as we type.

Why do I need an attorney?

Florida Probate Rule 5.030 requires that every guardian must be represented by an attorney admitted to practice in Florida unless the guardian is an attorney admitted to practice in Florida.

Who may be appointed Guardian?

Any Florida resident who is 18 years of age or older or any nonresident of Florida that is (a) related by lineal consanguinity to the ward (b) a legally adopted child of the ward or adoptive parent of the ward (c) A spouse, brother, sister, uncle, aunt, niece, or nephew of the ward, or someone related by lineal consanguinity to any such person or (d) the spouse of a person other wise qualified.

Who may not be appointed Guardian?

No person who has been convicted of a felony or has a confirmed report of abuse, neglect, abandonment, or exploitation. In addition, no person who may be incapable to perform the duties of guardian due to incapacity or illness or is other wise unsuitable.

What needs to be filed to open a guardianship?

The following forms are required to open a guardianship file:

- Petition to determine incapacity

- Petition for Appointment of guardian

- Application of guardian

- Investigatory Package (refer to question below regarding background investigation)


Why must I be investigated every year?

The 6th Judicial Circuit investigates guardians at least once a year as part of the Court's responsibility in ensuring that the best interests of the wards are being met.

What is required to be filed for my background investigation?

1. Nonprofessional Guardians being investigated for the first time must file the following:

Checklist (PDF download)

Completed fingerprint card (white with blue lettering) along with a $47.00 processing fee, check made payable to the FDLE, and is paid by the Guardian, not the ward's estate. Please PRINT and complete each box.

A signed Department of Children and Families release form (PDF download)

An investigation fee of $50.00 is due if you are a guardian of the person and property or guardian of the property only. A fee of $25.00 is due for guardian of the person only. Check made payable to the Clerk of the court and is paid by the Guardian, not the ward's estate. Please note on the check that the payment is the investigation fee.

2. Nonprofessional Guardians filing for their annual reinvestigation must file the following:

I received Letters of Guardianship, now what are my responsibilities?

As not all guardianships have the same requirements, your attorney should provide you with all of your specific duties. In general you may have to file an initial inventory and initial plan. Annually you may be required to file annual accountings and annual plans as well as submit to annual reinvestigations. If you are a nonprofessional guardian, you may also be required to attend the 8-hour guardianship course that will provide you with much of the information necessary to fulfill your fiduciary obligation.

Chapter 415 of the Florida Statutes provides for involuntary protective service under the Department of Children and Families whenever it is suspected that an elderly or disabled adult is the victim of abuse, exploitation, or self-neglect. These hearings must be held on an expedited basis. Often these cases result in criminal charges being filed for exploitation or abuse of the elderly or disabled adult.

The court employs a general master to hear all petitions for involuntary placement under Florida’s Mental Health Act, commonly known as the Baker Act. Approximately 2,000 Baker Act petitions are filed annually and subsequent hearings are conducted on a substantial number of the cases. The general masters also conduct all hearings under Chapter 397 (Drug or Alcohol Abuse) in the Sixth Circuit.

Your so-called journalist may indulge in Christian, Republican
or whatever fantasies excite her. We resists human rights
violations of a disabled woman.

Without leaders, we're unaffiliated with political parties or
religious businesses. We're neither dogmatically pro-life, nor
actively anti-abortion. Get it?

We're fed up with a handful of post-retirement Republican
judges and a visibly disturbed euthanasia lawyer who believes
God warned him about bringing down airplanes by visualization.

We're ticked off at cultural retrogrades presuming upon the
fate of a brain damaged woman, whom they falsely imprison in
a hospice rip-off operation in which they have or had board
seats.

Your hapless would-be journalist is out of her league

If you insist, send her to journalism school. It's your money

Better, leave Terri alone. Your readers will appreciate
remaining uninformed rather than taking on teenage
ferment of identity issues.

SP Times is pretty much Felosers mouthpiece. Probably the guy who wrote the article is the one I see at the press conferences and courts. He has slicked back grey hair, is not skinny, and is chummy with Feloser.

I don't trust Wolfson as far as I can throw him. I hate to be pessimistic, and will give benefit of the doubt but the fact that he has some kind of connections to the Hospice of Florida Suncoast bothers me. The judges are chummy with each other and I don't trust Demers. As far as I know Wolfson is a son of a wolf.. images of a wolf in sheeps clothing come to mind... we shall certainly see. I hope he has enough horse sense to not say that Terri needs to die.. there may be a revolution on certain peoples heads and hands if he does.
