But then this is the type of evidence that our politically correct legislatures and Judges have decided should be kept from Juries. In a "he said/she said" case such as this, the prior seuxual conduct of both parties is highly relevant. It should not be excluded. If she is sleeping with every Tom Dick and Harry, then you should be able to conclude that she just might sleep with every Kobe that came around as well.

Not to mention what kind of motivation several million dollars can buy. These laws have turned the entire US justice system into a joke. Now all that is needed to send someone to jail for years and take everything he owns is the word of the person who will be taking it.

It used to be that I'd totally ignore the Globe or the Enquirer. Not anymore after the Je$$e story broke.

I think some of us are getting really tired of hearing how this 'poor girl' is being smeared with the TRUTH. Perhaps that might explain a brief burst in anger on my part.

It would be like if they brought in credible witnesses(even if just for a story not the trial) that showed Bryant had a history of violent sex. I would hardly call that smearing, if it's the truth.

I find it interesting that no matter what comes out, there are certain people who have not changed their opinion.

You can't say I didn't, because for a few weeks I was starting to think that maybe there was a lot of blood(rather than a barely visible spot) and real injuries on her.

But facts will not bother certain people on these threads. And we know why.

I think it is possible Kobe is innocent of rape.

That being said, I know nothing about his basketball career and do not worship him as a superstar.

However, it appears that the prosecution's case keeps weakening. Mackey is worth her weight in gold!

I'll wait for the trial, but I don't think it was "agreed to" right up front.

I'll stick with facts. Don't confuse that with what you call a "presumption of guilt".

The girl was told by police right up front that she would be in big legal trouble if she was filing a false report, that's where I got that idea. It's called basing my ideas on the factual record.

Unlike you evidently have, I have not reached any conclusions. But I do have my brain in gear and can separate the wheat from the chaff and I do lean toward his having used force. Doesn't mean I'd convict if I were on a jury. Hope that last notion isn't too much for you to process.

This "witness" will not prove to be a good one. They may choose not to call him to the stand. Now, is it HIS semen in her panties? Or yet another man's?

I still cannot believe that the D.A. would choose to go ahead with a case like this. I also can't believe she, after being warned of the dangers of falsely crying rape, would go forward with it, either. This can't be good for her reputation (but perhaps better for her reputation than being dead, as she attemtped to become twice in the past year). There is no understanding some people.
