Senate Democratic staffers and a judge appointed by President Carter made extraordinary efforts last year to ensure that a liberal majority sat on the federal appeals court that heard the Michigan affirmative action cases, according to internal Democratic staff memos.

After reading about the internal memos, Mr. Fitton said he wondered if there were any communications between Kennedy staffers and then-6th Circuit Chief Judge Boyce F. Martin. Judge Martin has since been accused of judicial misconduct for manipulating the makeup of the appeals-court panel that heard the case, which involved white students who said they were discriminated against by the University of Michigan's admissions policies.

After what the Dems did to Judge Pickering and they pull a stunt like this??

Ah. So the democrats are stalling judges so they're little fascist political program can be advanced by judges sympathetic to the cause.

Notice that when the Democrats, particularly Kennedy and Rockefeller, are caught in these sleezy deals, there is always this phony outrage that someone has illegally gotten the information! The Republicans need to be much more forceful in making the point that the crime is not in finding out about all this dirty political dealing that the Democrats live by.

This provides grounds to have the ruling vacated, and to have the judges responsible impeached.

If the Republicans were serious about politics, they'd get right on it. I'm not holding my breath.

The fix has been in for over a decade now. And didn`t SCOTUS basically agree with the lower courts ruling on this issue? We ,the voters , can vote these liberal judges off the bench in most cases, why we retain them again and again is very telling about the knowledge of the majority of the voters in this country.

Seriously. I hate the fact that our Republicans in Congress always seem to leave their spines at home when they get to the Hill. It's time to make a serious $h!tstorm out of something, and I can't think of anything better.

This case is entirely federal, as are most of the big issues. The appointments are lifetime - they can only be removed by impeachment.

another reason to vote libertarian or Pat buchannon.....you get all these demonrats controlling the judicial arm of the government, and thus, nothing will ever change ...

we ought to be trying to win the war, not just the battles....

as long as demos control the judges, they control everything....

If you allege a federal issue, you start at federal district court. That's what was done here. All those guys are appointed too.

I understand the federal case issue, I am talking about the judges themselves. They are drawn from the lower courts in most cases and then appointed to the federal bench. Why are they even available in the lower courts for a possible appointment to the federal level to begin with? That was/is my point. If the lower courts are void of these liberal judges , then it would be easier for us to knock down this trend that has been occuring in this country for decades. It will not happen overnight either, it will take a long time before people actually get it that this situation can be changed by "us". Get them out early !!

I see your point squidly, however, don't you think that the GOP's method of playing is the primary reason that they achieved majority status, or better yet that the Dem's lost it because of their political playing?

Give it time, so far it's working, but in a country of 235 million people it takes more than a day!

One has to chew their food thoroughly, for digestion to have the best effect without adverse repercussions which is especially tough to do while spitting liberal fodder out at the same time.
