Sometimes a judge will get aggravated, throw out a case with prejudice, and assign court costs. But, its all too unusual here.

With a VERY hefty deposit in case they think they can stiff him for the cake.

The issue is that they still lose financially! It will ruin the business! THATS what need to be compensated for in the ruling. The defendant needs to be made whole in all respects, not just winning.

In 2018, the U.S. Supreme Court cleared Jack Phillips, a devout Christian who owns Masterpiece Cakeshop in Lakewood, Colorado, of any wrongdoing after a same-sex couple sued him for denying them a wedding cake as it went against his religious precepts.

IIRC, SCOTUS basically only said that CO did not treat the cae impartially, instead of vindicating Masterpiece for refusing to be complicit in the celebration of an immoral and (at the time) illegal wedding. Here was a prime chance to justify the refusal of Masterpiece, but since SCOTUS essentially criminalized the refusal of states to recognize homosexual marriage, they basically only ruled in favor of Masterpiece due to bias.

In a 7–2 decision, the Court ruled on narrow grounds that the Commission did not employ religious neutrality, violating Masterpiece owner Jack Phillips' rights to free exercise, and reversed the Commission's decision. The Court did not rule on the broader intersection of anti-discrimination laws, free exercise of religion, and freedom of speech, due to the complications of the Commission's lack of religious neutrality.

The opinion stated that although a baker, in his capacity as the owner of a business serving the public, "might have his right to the free exercise of his religion limited by generally applicable laws", a State decision in an adjudication “in which religious hostility on the part of the State itself” is a factor violates the "State’s obligation of religious neutrality" under the Free Exercise Clause of the First Amendment to the Constitution. ..Kennedy's opinion noted that he may have been inclined to rule in favor of the Commission if they had remained religiously neutral in their evaluation.

Justice Clarence Thomas wrote another opinion, concurring in part and concurring in judgment, joined by Gorsuch. Thomas found that the majority opinion did not consider the free speech, free exercise or the anti-discrimination implications of the case, despite significant attention during oral arguments.[32][33] Thomas opined support for Masterpiece, both on grounds of free speech and free exercise.[34] - https://en.wikipedia.org/wiki/Masterpiece_Cakeshop_v._Colorado_Civil_Rights_Commission#Opinion_of_the_Court

Great idea, but I’ll go you one better. Phillips should charge extra for the cake and give the proceeds to n organization that protects a Christian’s right NOT to be forced to pander to perverts.

No, he needs to stand on his right to refuse a commission for any and all reasons.

What you are suggesting is to make everyone in business a slave. It is sort of like the joke that ends, "Of course you are, now we are only negotiating your price."

I have the absolute right to refuse any commission that does not appeal to me.

This is an absolute right and I refuse to play stupid games because I know that if I do I will lose that right, forever.

WTF is a Civil Rights Commission?

I found a good example from the good Christian people at The Berean Call:

One Canadian columnist gives his perspective: “For more than twenty years…I have been writing against the human rights commissions, which have quasi-legal powers that should be offensive to the citizens of any free country. They are kangaroo courts, in which the defendant’s right to due process is withdrawn. They reach judgments on the basis of no fixed law. Moreover [in addition to heavy fines], ‘the process is the punishment’ in these star chambers—for simply by agreeing to hear a case, they tie up the defendant in bureaucracy and paperwork, and bleed him for the cost of lawyers, while the person who brings the complaint, however frivolous, stands to lose nothing.”

FB will not allow posting from LaCorte News. They did the same thing to me the other day with a different story. I had to find another source for the story in order to post it.

It holds this man up as an example.
