Cruz and Rubio to remain on ballot, Broward judge rules

A Broward judge on Friday struck down a Hollywood voter's attempt to remove Ted Cruz and Marco Rubio from the Republican presidential primary ballot.

Michael Voeltz, 54, filed a lawsuit seeking to declare Cruz and Rubio ineligible for the presidency because, Voeltz argued, they are not natural-born citizens.

Cruz was born in Canada to an American mother and a Cuban father, while Rubio was born in Miami to Cuban immigrants who later became citizens. Both men, Voeltz argued, benefited from laws that made them citizens without putting them through a legal naturalization process.

Voeltz, who represented himself and is not an attorney, took a scalpel to the legal definitions of "natural born" and "naturalized," arguing that one cannot be both at the same time. "You can attain citizenship by an act of naturalization or by birth," Voeltz argued....

was talking to a physician tonight who had to take a citizenship test as she is columbian. she says she was shocked to find out that Ted Cruz was running as she was informed that she was ineligible to run for POTUS because, specifically, she was not born in the US.

The judge’s decision means nothing. The matter can only be settled by Congress.

No, the fix is in, as it was for Obama.

In a way, it's worse, since Obama purportedly had a birth certificate; but I haven't figured out how one can be a "natural born citizen" of the US yet also have to renounce Canadian citizenship...

Are you feeling stupid yet since you did not read the article?
He did not rule on the merits of Voeltz’s argument about what constitutes a natural-born citizen. He just stated that it should have been filed with the Florida Secretary of States office and not his jurisdiction.

Bowman agreed, saying Voeltz made a mistake that was fatal to his case when he removed the Florida Secretary of State as a defendant. The Secretary of State's office oversees the Division of Elections and is the only body that can be ordered to remove a candidate from a ballot.

He did not rule on the merits of Voeltz's argument about what constitutes a natural-born citizen.

The judicial branch of the government is every bit as political as the executive and congressional branches. So this is not surprising in any way... If either Rubio or Cruz makes it to the General and this is heard before a Democrat judge the outcome will most likely be quite different. Anyone who thinks otherwise is a fool.

Note the reference to Natural Law in the first sentence of our Declaration of Independence.

It is crystal clear that the Founding Fathers used the Natural Law definition of 'natural born Citizen' when they wrote Article II. Ted and Marco won on a technicality, a faulty pleading which is the Complaint comes with the Court. Once again, a technicality saved them in another Court where this kind of suit was filed.

Cruz: “Sure, go ahead.”
Interviewer: “What is your understanding of how one becomes a natural born Citizen?”
Cruz: “Two citizen parents and born on the soil.”
Interviewer: “Not exactly, but as I don’t have enough time to fully explain how one does become an natural born Citizen, based on your understanding, would you agree that Barack Obama is ineligible to be POTUS?”
Cruz: “I would agree.”

Did you tell her that Cruz was born an American because he had an American parent? If she is that stupid then she will fail her citizenship test.
