Bolton: ‘Brilliant Lawyer’ Cruz Will Make Scalia Replacement and Constitution an Issue

On the Fox News Channel on Sunday, former UN Ambassador John Bolton argued that Republican presidential candidate Sen. Ted Cruz (R-TX) will make Antonin Scalia's replacement an issue, as will Hillary Clinton, something he views as a positive development

Bolton, who called Scalia to inform him he was confirmed, said that when he told Scalia the Senate had confirmed him 98-0, "[T]here was sort of a silence at the other end, and he said, 'Who were the two who didn't vote?'" And that Scalia laughed at the irony that Barry Goldwater and Jake Garn, two conservative senators were the only two who didn't support his confirmation.

Bolton added that Scalia "is just about the last of the really visible, articulate, clearly conservative justices ever to get through the Senate." He later characterized Scalia as an "intellectual giant."(continued)

I knew immediately the magnitude of the loss, but the emotions of it, for me, keep growing. It is just a tragic loss for all of us. Devastating.

He knows originalism. He was a clerk for Renquist and was friendly with Scalia.

Sounds like Ted Cruz had dinners with Don Willett and Scalia whenever Scalia was in Texas.

I wish John Bolton would run for something...his reasoning power is not chopped liver, either.

Bolton, like Christie, is in favor of Big Brother "national security" measures that threaten fundamental civil liberties under the guise of protecting the "Homeland." He's also a bit too fond of international coalitions.

Bolton is also one of the guys who has never seen a war we shouldn’t be involved in.

He’s got his strong points but he’s been in Washington for far too long.

Justice Scalia: I think, I didn’t say that if there is to be an evolution of standards under the Eighth Amendment, it’s up to the legislature. No, the legislature can’t change the Eighth Amendment. I’m saying the Eighth Amendment means what was cruel and unusual and unconstitutional in 1791 remains that today. The death penalty wasn’t, and hence it isn’t, despite the fact that I sat with three colleagues that thought it had become unconstitutional. Executing someone under eighteen was not unconstitutional in 1791, so it is not unconstitutional today. Now, it may be very stupid. They can legitimize homosexual sodomy. All of these things, all of these changes can come about democratically. You don’t need a constitution to do that. And it’s not the function of a constitution to do that.

Justice Scalia: Oh, substantive due process does. I thought I made it clear I don’t believe in substantive due process. The basis of Lawrence, of the Lawrence opinion was that the government has no business making moral decisions regarding sex. I predict that that rational will not survive. Because there are just a whole bunch of laws from the very beginning of the world, that every society I know of has enforced. You can start with bigamy. This is simply a moral disapprobation of sexual activity deeply felt by the society. And it has never been unconstitutional for the society, for the majority, to impose that judgment. Now maybe it should be, but don’t tell me that that’s what the American Constitution has required. It might be a good idea. Persuade your fellow citizens that government should make no moral judgments. It’s simply not our history.

Sessions was on Levin’s show tonight. Praised Scalia as a man of faith and said we need more of that in Washington since that truth is the underpinning of our Constitution.

The unfortunate problem with this whole mess is that the concept of judicial review is a fraud. The SCOTUS usurped the power, rights, and responsibilities of Congress and the President almost from the beginning. Their only legitimate function is to determine if the laws passed by the legislature and enforced by the executive are being properly applied (”balls & strikes”), not if they are legal or illegal. Elimination of judicial review returns the court to its proper, limited function and avoids all this appointment drama.
