Yes, Cruz became a Senator in 2013 and was a lawyer for the State of Texas in 2005 when Roberts was nominated.
But Senator Cruz went back in time to 2005 (again when Roberts was nominated) and spearheaded Roberts through the Senate. Cruz snuck in using his Senate pass from 2013.

Google how it was Cruz who brought Robert into Bush 2000 recount Bush didn’t ask him. Cruz and Roberts were decades long friends. While Cruz did not nominate him which by the way he did not have authority to do, he praised him highly. Google it
Cruz, at age 28, helped get Roberts on board for Bush v Palm Springs Count and Buh v Gore in the 2000 election hubbub. Bush won both. Bush nominates Roberts in '05 for SCOTUS. Cruz, at age 33, says "That's a good choice, he was good with us five years ago". Roberts goes on to become one of the four Conservatives in the 4-4-1 split (Kennedy being the Swing)... but... Roberts fails to scuttle ObamaCare, and therefore Cruz is no longer Conservative, and his 20 previous years of work are meaningless compared to Trump's new discovery that he was never really a NYC liberal. Duh.
Cruz says I am in favor of ObamaCare, when in fact I have spoken about repealing and replacing this disaster of a system at every speech throughout my campaign and since it’s inception. Meanwhile, Cruz was responsible for getting Bush to put in the judge that failed to vote against ObamaCare twice.
