PS - In this case it is clearly a retaliatory stop as the reason for the stop is listed as an air freshener hanging from the rear view mirror since they can’t cite for the finger. They were cited for this as an obstruction to view after the fact.

You may want to research what you just posted about a bit more. Not sure where people get these myths from. Qualified immunity is ONLY available if the govt employee is actually doing THEIR JOB when the harm occurs.

He was doing his job. I watch multiple similar reports daily and unless the officer was not on duty, he is covered by qualified immunity.

Even in those cases where cops raid the wrong house and kills an innocent they are generally covered by immunity.

“Qualified immunity has been used in many cases to protect officials who have engaged in a variety of misconduct, including fatal shootings, police brutality, stealing, sexual misconduct, and more.”

Is it the police's job to stalk people that give them the finger and then use pretext as probable cause to stop them and beat their azz? NOPE. I've actually litigated similar situations against state and local govt. employees. In one case the employees were sued in both their official and personal capacities. Official capacity means the Govt is responsible, individual capacity means they're personally responsible. Boy were they pissed when the judge said their motions to dismiss the suit against them in their personal capacity were denied. Just because they're at work on duty and wearing the uniform, they are not always covered by qualified immunity.

Here is a fairly interesting case where an off-duty deputy went road rage and was initially arrested yet also granted immunity, but was later stripped of his immunity in the court process.

The problem with young folks disrespecting the police, is they have no fear or respect for authority. I am all for tuning up more people. First thing they should do, is beat the snot out of those who show no respect. If I were a young man and I lipped off to the cops, and they put a whoopin’ on me, he would have said, “you asked for it”. The same is true for first offenders, they should get maximum jail time. Juveniles should be put in Juvenile jail, with indefinite jail terms. If they are 15, they should get 10 years, and get out early if they behave in the kids prison. As it is, they go there, act out worse than they did before, and get out when they are 18 having their criminal game honed for a life of being a punk.

Interrupting a policeman working on a case could be considered actively hindering the officer. A chargeable offence.
Not all speech is free(as in ANYTHING can be said) in that sometimes there are legal consequences.. Perjury, threats, false warnings, disturbing the peace, interrupting a meeting, are examples of restricted speech.

No reason a cop can’t follow you.

Yeah there kind of is.

They need to have a reasonable justification.

Otherwise they are just being a stalker.

More and more people are recording their encounters with the police and more and more police are getting caught being bad actors.

You would think that knowing that you are being recorded would result in you being on your best behavior but some people just can not control themselves.

Of course the recording works both ways. Police who behave properly are kept safe by the fact that they can SHOW that they behaved in a professional manner.

It would.

People need to realize that having the police be not just citizens who arrest and investigate but judges and punishers with no restraints is a bad road for any country to go down.

The way some police refer to non-police as "civilians" is a bad sign.

Because if the police are not civilians then what are they?
