It is seen as a potential gift where the Dems change laws, and California is moving ever more in that direction. The trial lawyers’ associations all seek more “laws” to motivate their clients. and, as you correctly note, “They will just try again but for now it is dead.” So not really dead, dead, dead. More like, lying in wait....
