SANTA FE, N.M. — Moments after involuntary manslaughter charges were to be filed against Alec Baldwin and Hannah Gutierrez-Reed, First Judicial District Attorney Mary Carmack-Altwies spoke to CNN about the charges being filed.

Transcript

uh well along with my special prosecutor, we got the report from the santa fe County Sheriff's office. We initiated an extensive review of that and I will say that it was *** it was *** well investigated case, but we had some follow up that we had to do had to speak with some experts and and once we read through everything and researched the case law and the law here in New Mexico, we realized that we believe that there was probable cause to charge alec baldwin and Hannah Guterres, read with involuntary manslaughter. And what were some of the key pieces of evidence that you used that factored into that decision? Well that there was such *** lack of safety and safety standards on that set um that there were live rounds on set. They were mixed in with regular dummy rounds, nobody was checking those or at least they weren't checking them consistently. And then they somehow got loaded into *** gun handed off to alec baldwin, He didn't check it, he didn't do any of the things that he was supposed to do to make sure that he was safe or that anyone around him was safe.....

He’ll be incarcerated in the style in which he is accustomed to live. Wet bar, gourmet commissary, Internet, wife and mistresses to make conjugal visits.

I am no fan of Alec Baldwin. But these criminal charges specific to the death are just wrong. The slippery slope alone should scare every blue collar worker that makes a mistake (i.e. the HVAC guy that fails to prevent a CO leak, the electrician that fails to prevent a short) resulting in a death goes to jail now? Put your brain on this and everyone can come up with a tragic circumstance because of an accident.

Oh come on Guido - he fired a gun at her! Yeah, yeah, it was a prop gun allegedly loaded with blanks... until it wasn’t.

> HVAC guy that fails to prevent a CO leak... <

Then the question becomes why was the leak not prevented. Sometimes stuff just happens. Then it’s a civil case, at most. But sometimes the person is grossly negligent. For example, maybe the HVAC guy used the wrong part because he was too lazy to check the specs.

Baldwin was grossly negligent. The charge is appropriate. Of course, your mileage may vary.

Your attempted comparison is absurd.

There is a difference between a worker who in the course of doing his job overlooks or doesn’t catch something that results in a death, and one who recklessly points a firearm at another human resulting in death.

Not quite the same example as pointing a loaded gun at someone and pulling the trigger.

Enh. Let him sweat charges. He can afford the attorneys, and his main crime is being an arrogant turd. Pass the popcorn.

Aside from that, it’s basic gun safety that when somebody hands you a gun, you open the action and make sure it’s not loaded, especially before pointing at someone, which should never be done, and putting your finger on the trigger. And the armorer should have given it to him with the action open anyway. Both he and his moronic armorer deserve all the grief that’ll be coming their way.

“We figured out that, if we did not charge Baldwin with a slap-on-the-wrist crime then the next prosecutor could try Baldwin for premeditated murder. Guilty or innocent, this way it will be over with minor-to-no punishment.”

That’s the issue. He fired a gun at her. If he had any reason to believe there was a live round in that weapon, then perhaps there is criminal culpability. But what happened here was not just an accident but a workplace accident with moving parts leading up to it. I just do not see a criminal case here.

In my line of work I see hundreds of workplace injuries that are a result of gross negligence and even recklessness leading to horrific injuries and death. Criminalizing that conduct is just wrong.

And do not get me started on the apparently mandatory-minimum of 5 years because a firearm was involved. This is either overreach or a publicity stunt by the DA. No way should the case get past a preliminary hearing.
