Five big unanswered legal questions in the Trump raid case

The court ruling clearing the way for Americans to get a glimpse into the reasoning behind the FBI raid on Donald Trump's estate may shed some light on the state of the criminal investigation but likely won't answer many of the substantial legal and political questions bedeviling America.

1. Did the 45th president declassify the documents found in his home?

2. Did President Joe Biden have the constitutional authority to waive executive privilege over Trump documents sent to Congress or the Justice Department?

3. Were some of the records seized by the FBI previously deemed personal records by Trump?

4. Was the approved search warrant overly broad, and did it result in illegal over-collection of evidence?

5. Is the FBI investigation properly predicated to laws that have a criminal enforcement component?

The FIB got away with RussiaGate via Court acquiescence, and will do so again — unless this somehow makes it up to a higher court, which, given the courts’ record on things Trump, is unlikely.

Meanwhile, we live under arbitrary rule.

If it was legal for a sitting President to declassify the documents at the time he left office, then it shouldn’t be legal for a new President to classify those documents.

No one was concerned from former Presidents, until Trump.

I think the warrant was overly broad.

.... if you don't articulate the probable cause you have nothing...that's the reason for the affidavit, incredible that a magistrate would sign that without demanding they articulate the probable cause imo.

4th Amendment:
“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

As has been pointed out elsewhere...if they had anything on him there would have been no redactions.

Now all you have is speculation and the creation of doubt instead of proof.

Me thinks the Fibs venue shopped for a judge they already had compromising info on. Magistrate Judge Bruce Reinhart (not really a constitutional judge) fit the bill. I hope the judge has the beans spilled on him anyway.

We already know he did. Right after the raid, one of Trump's legal advisers who is also a well-known author, stated as much. Then a week or two ago Trump posted the official Standing Order Declassification on Truth Social. Case closed!

6th Question: Did the government or its operatives time the warrant request to coincide with the vacation of the regular magistrate so that Judge Bruce Reinhart would be the substitute deciding on their application? Was the regular magistrate’s schedule known, and to whom?

What is the regular magistrate on vacation? I haven’t heard that. However it would make sense because they wanted Reinhart to be the judge as they knew that he was biased.

They got precisely what they wanted, the creation of a spectacle surrounding Trump. They will make any claim and take any action in pursuance of defaming Trump, with no regard for truth or legality. There are no consequences for this utterly corrupt behavior.

Question 2 is problematic for Brandon on several points.

He knew nothing about it, or so he says, so he couldn't have been consulted, much less given an opportunity comment or issue a waiver.

Let's say "The White House" issued this statement, did Brandon even see it, initial it, or have any knowledge of it?

Who, then, in the White House acted as President without Brandon's knowledge? Who's really in charge, and should someone tell Brandon who that is?

Where did you get that information?

There was a post to that effect, I'll see if I can dig it up. Same post as I recall predicted the Special Master appointment and the judge that will likely be named.
