If the police have not identified a killer, it seems to me that nobody can say any theory about the matter is “false” with much certainty. You could say the theory is “unproven”, or even “unlikely”, but you probably can’t say it’s “false”.

Good point. To say it's "false" is itself to go beyond the evidence.
