Just because it was in her system does not mean she was impaired. She could have smoked a week earlier and it would have still showed up in her system. Some of us who deal with these things in a professional capacity have used this inconvenient fact to support our efforts against legalization of marijuana. It makes no sense to legislate against impaired driving while at the same time legalizing formerly illegal substances that can't be accurately tested for impairment.
