How about psychiatric examinations of the first responders who thought it was cool to show off pictures of mangled and burned bodies of someone else’s loved ones. I would be enraged and would want justice. It is insulting to Mrs. Bryant require her to be evaluated to gauge her level of grief. If I were her I would submit to an evaluation let loose her full rage and grief at the psychologist and scare them a little.

This is not unusual. Competent defendant’s counsel will always request an examination by a psychiatrist or a psychologist whenever the plaintiff is seeking damages for mental distress. See FRCP Rule 35. The expert will then use information gathered during the exam to offer alternate causes for the plaintiff’s mental issues. That’s just what they do.

The people who does that violated professional norms. Are they suggesting that if they just happened to luck out and victimize somebody that doesn’t get traumatized by it, they shouldn’t have to pay??

The lawyers propose that the evaluations be audio- and video-recorded and last eight hours for adults and four to six hours for children.

"Now, little girl, I'm going to lock you in this booth, alone, for four to six hours with all these glossy, 8x13" color photos of the mangled and burned bodies of your loved ones. You will be under video and audio surveillance the entire time. This is to determine if you have suffered any psychological trauma..."
