How the Impeachment Trial will undermine the Biden Presidency:

How the Impeachment Trial will undermine the Biden Presidency:

There is no provision in the US Constitution that provides for any person other than the Chief Justice of SCOTUS to oversee an impeachment trial of POTUS. It is explicit!

Any senator or congressman or congresswoman is disqualified from presiding over said "trial" of a citizen (other than the POTUS, here, Trump) as they are not impartial, (having been either for or against him in the first trial) which would be grossly improper.

The impeachment article reads that it concerns "Donald John Trump, President of the United States" which is now NOT TRUE. The article is invalid because Trump cannot both be POTUS and NOT-POTUS. If TRUMP is not POTUS then the impeachment article which references him as POTUS is invalid, expired, abrogated, annulled, moot,...whatever word you want to use. New articles of impeachment would need to be drawn up and voted on.

But, the US Constitution provides no provision or rule as to the impeachment trial of a private citizen. Therefore Congress has no such power as the US Constitution works on the basis that whatever power is not granted to the FED.GOV is reserved to the States, or to the People.

An explicit impeachment or law intended to prevent a private citizen from running for public office in the future constitutes a bill of attainder, which is obviously unconstitutional.

So if Trump is re-tried AS PRESIDENT and acquitted again (which he will be) he would therefore have been recognized as STILL PRESIDENT by both houses of Congress and should replace "Benedict Biden" in the White House THAT VERY DAY. Q.E.D.

I honestly don’t care about the impeachment one way or the other. It’s theater. It’s a puppet show. It’s just a noisy pantomime.

It doesn’t matter. The dims laugh at the constitution. They make lawyerly arguments and that is that. This is all politics and we’ve seen how far the dims are willing to go in that regard.

If the Rats move forward with that article of impeachment, they are recognizing that President Trump is still President, and he should show up and take his rightful place in the Oval Office.

They do indeed sir. If I am not mistaken, the Soviet Union had a constitution too, but I figure, only idiots (democrats) would think Stalin paid any attention to it.

“The article is invalid because Trump cannot both be POTUS and NOT-POTUS.”

Well that explains why they’re so keen on convicting him: he’s POTUS.
They know he won. They’re trying to retroactively remove him from the race, leaving Biden the only legal winner by default. Twisted, but makes for an imperative in their axioms.

All it will do is make Trump supporters angrier because it is happening, and Trump haters angrier because he won’t get executed.

Better yet, if they are able to retroactively “remove” Trump as President when he’s no longer in office, that means the trial is going by the power structure of the government that was in place on Jan. 6, 2021, which means Mike Pence should be sworn in as President the instant that Trump is “removed”.

The Dems will “pack” the court, now that Roberts won’t preside.

Part of their plan all along, knowing the impeachment will go nowhere.

I think the demonrats made a BIG mistake in going ahead with this.
By doing so they admit that Donald Trump is the legitimate President and biden isn’t.
That means that everything that biteme has done is null and void.
That means the States, the Indians, and keystone can ignore his orders.🤔

When the articles of impeachment were presented to the senate someone should have torn them up like Nancy did to the state of the union papers.
