Senate GOP announces constitutional amendment to block court packing

A group of Senate Republicans on Monday announced a constitution amendment to fix the Supreme Court at a maximum of nine members, playing defense as Democrats ramp up talk of expanding the court to try to swamp President Trump’s picks.

The GOP lawmakers also proposed changing Senate rules to require a supermajority to vote in favor of increasing the number of justices.

“For the sake of our liberties and the future of our country, we must preserve our independent judiciary. These proposals would do just that,” said Sen. Ted Cruz, Texas Republican, who is leading the effort.

The number of justices is set by law, and at the start of the republic was set at six. It’s been as high as 10, but has been set at nine justices for about 150 years.

If Trump packs the court, he should push for a temporary repeal of the 22nd Amendment as well.

I don’t agree. This Amendment is the way to go.

But also I think we need to make a 2/3 approval by the current states to add a new state, e.g., Puerto Rico.

Does it not now take two-thirds vote in the House and Senate and approval of three-fourths of the state legislatures before it becomes effective?

Changing US Senate rules to require two thirds majority vote to change the composition of the Supreme Court should be straight forward. All they gotta do, is get that vote in before the end of this congress.

raising the standard to admit new states is more pressing IMO. the Articles of Confederation required 9 of 13 states to admit a new state. The state of Franklin received a majority of 7 votes and failed to become a state.

GOP senators appear to be trying to exploit constitutionally low information patriots with election year stunt to strengthen their support. Too bad they didn’t get primaried.

Patriots are reminded that, alternatively to a Constitution Convention, 2/3 of both Houses of Congress must first agree (ahem) to propose a new amendment to the Constitution to the states for ratification.

Even then the states can choose to either ratify proposed amendment or ignore it.

If this were a better world, GOP could at least propose a new amendment to repeal the 16th and ill-conceived 17th Amendments imo.

In the meanwhile…

Send "Orange Man Bad" federal and state government desperate Democrats home in November!

Supporting PDJT with a new patriot Congress and state government leaders that will promise to fully support his already excellent work for MAGA and stopping SARS-CoV-2 will effectively give fast-working Trump a "third term" in office imo.

I don’t see any problem with voting Republican ticket for 2020 elections.

Oh puleeze.
They don't need no steeenking constitutional amendment to change Senate rules to require a two thirds majority to make changes to the Supreme Court composition.
The GOP Senate did just that once already when they changed Senate rules to require a simple majority to require only a majority vote to confirm a Supreme Court Justice. They did this before the Kavanaugh confirmation in 2018. They can do it again to require a two thirds majority to change the number of Supreme Court judges. Easy.

IF the dems get the presidency, the senate, and the house then they will pack the court and then pass a constitutional amendment preventing anyone from packing it further in the future

The Dems can't pass a constitutional amendment. They will not have the votes. Republicans control more states than the Democrats. You need three quarters of the states which the Dems don't have.
