The white bar owner who shot and killed a 22-year-old black Omaha man fired in self-defense after ending up on the ground in the middle of a group Saturday night, Douglas County Attorney Don Kleine said Monday.
In turn, Kleine said, Jake Gardner, owner of The Hive bar near 12th and Harney Streets, will not be charged in the death of James Scurlock. Kleine said he reviewed the evidence — and interviews with witnesses — and determined that Gardner had acted in self-defense.
Kleine played video of the confrontation at a 1:30 p.m. press conference, currently underway.
A law enforcement official with knowledge of the video gave this account:
Saturday night, standing outside his downtown bar, Gardner urged the crowd to move along.
Gardner could be seen talking with a group of young men, including Scurlock, and backing up. In one video circulating online, a cellphone user says, "That (expletive) got a gun."
Words were exchanged, and Gardner ended up on his back in the middle of Harney Street. He fired two warning shots, the source said. The skirmish continued, and Gardner remained on his back, with Scurlock getting Gardner in a chokehold. Gardner fired again. That shot hit Scurlock in the neck, killing him.

Gives the media job security.
If you are lucky and live in a state like Nebraska, you can shoot in self defense if you are lying on the ground being kicked and beaten, and they will present it grudgingly as being justified.
I’ll bet in my state, I would be charged. (Not really, but...I think there are states that would. In my blue state, I took a course that illustrated that my right to defend myself would be clear in that situation, but I’ll bet there are places that might not be true. And even if the law was on my side, I am still not 100% confident. Sad.)
So if he would have been singing a rap song it would have made a difference?
If nothing else, James Scurlock sure as hell won’t be wrapping his hands around anyone’s throat anytime soon.
A sad lesson for him to learn. I can only hope that some others out there might learn from this.
As terrible as this whole George Floyd tragedy is, from the Bureau of Justice Statistics we see in 2018 there were 549K black on white violent crimes in the USA and 59K white on black violent crimes.
This is almost a 10 to 1 ratio of more black on white violent crimes than white on black violent crimes. IT IS ALL BAD.
Placing our faith and trust in the Lord Jesus Christ, sharing His love and Gospel to others, and seeing people as Almighty God sees them made in His image and likeness - this is what is needed in our country.

Yes, every one of those rioters who participated in the crime are guilty of murder.
In FLorida shooting someone looting your store would not lead to arrest of the owner except in South Florida where he would get off in the courts.

Kleine said one protester who was interviewed by investigators said, “I’m not a fan of the police department, but I was there and I didn’t hear anything like that (slurs) when I was standing there.”

Someone gets attacked and has to shoot someone to save his own life and all they are worried about is *racial slurs*???????
The attacker who ultimately ends up being shot clearly attacks the defender and tries to put him in a rear choke before the defender shoots him. This is a clear cut case of self-defense unless you believe that the guy who was attacked has an 'obligation' to allow himself to be choked out in the name of "social justice".
The fact that the news story mentions race at all is completely unnecessary unless they are purposely trying to stoke the flames, hoping to get a secondary riot going.

Any thug that continues the attack after 2 (ill-advised) warning shots, has already placed his final bet.
