The U.S. patent number US 7,220,852 B1 w issued for the SARS-COV genome in 2007, applied for in 2003, covers the period in which the primate testing with chloroquine to treat SARS-COV occurred. The CDC is listed in the Assignee box. This patent appears to be recently expired.

This patent may have encumbered anyone seeking to further develop a treatment for the Coronavirus family of diseases, based on work associated with that outbreak. SARS receded into the background after the outbreak of 2002-2003. The connected research has now become applicable to the current viral outbreak, and is not limited by this prior patent. New vaccines will obtain patent protection, and a price tag to cover development costs.
