If the hospital/physician in question is following "accepted standards of practice" (IIRC that's the term that lawyers use) you could get all the lawyers on earth and you'd lose.

Patients don't have a "right" to receive any experimental treatment.Patients can be allowed to participate in a medical study if those managing it say OK...but it's not a right.
