I’m surprised they haven’t just found a federal judge to overrule the electoral college. After all, courts have managed to find a right to an abortion in the Bill of Rights ratified in 1791 (think how likely that’s what the founders intended) and a right to gay marriage in the 14th amendment which was ratified when homosexuality was a death penalty offense in some states. They’ve also managed to interpret the second amendment’s text “the right to keep and bear arms, shall not be infringed” to not actually mean that you can keep and bear arms.
With all that it should be a simple matter for a democratic judge to rule that Article II, Section 1 doesn’t actually mean it where it says the electoral college elects the president, it really means that we elect the president by direct vote because, you know, that would be fairer and it would help with climate change which is clearly what the founding fathers were worried about.
That will be to me for 45 states to succeed from the union.
Take away the popular vote in either California or New York and Trump won the other 49 states by 1.5 million votes. The Electoral College worked as intended.
Tar & feathers before or after a good caning?
Yes.
Good luck with it.
Democrats need to get it past the Senate. They have better odds of being struck by lightening than in abolishing the electoral college.
