FULL TITLE: Federal Court Rules Parents Dont Have a Right to Know When Their Daughters are Considering an Abortion
A federal appeals court upheld a block Tuesday on an Indiana law that requires underage girls to inform their parents before having an abortion.
A Seventh Circuit Court of Appeals panel allowed the block to remain in place, rejecting an appeal from the state that asked to be allowed to enforce the law, the AP reports.
The law, which passed in 2017, strengthens current Indiana laws regarding parental rights by requiring abortion providers to obtain proof of consent from a parent or legal guardian before a girl under 18 has an abortion. It gives parents/legal guardians a civil recourse if someone fraudulently poses as a parent in order for a minor girl to get an abortion. It also makes sure parents are involved if a minor appears before a judge to request an abortion without her parents consent.
The Planned Parenthood abortion chain and the American Civil Liberties Union filed a lawsuit challenging the parental consent law the same year. Their lawyers argued that abortion clinics should be allowed to perform abortions on young girls without their parents knowledge. A lower court later issued a preliminary injunction blocking the law.
The Seventh Circuit judges agreed with the injunction this week.
The State has not yet come forward with evidence showing that there is a problem for the new parental notice requirement to solve, let alone that the law would reasonably be expected to solve it, Judge David Hamilton wrote in his decision, WBAA News reports.
The ACLU of Indiana claims the provisions violate young womens constitutional rights by imposing new burdens on their access to abortion.
However, Indiana Right to Life President Mike Fichter previously said parents should have a role in decisions that affect their underage daughters health.
Planned Parenthood claims abortion is a womens right, but this rhetoric forgets were talking about young, minor girls, he told LifeNews. An abortion is not a trivial health decision to be made lightly. Parents deserve to be involved and informed.
Parental notification/parental consent laws have strong public support. Currently, 37 states require some type of parental involvement in a minors abortion, according to the Guttmacher Institute.
These laws can help protect young women from abusive situations. Sexual abusers have been known to take their young victims to abortion clinics when they become pregnant.
In 2008, a Planned Parenthood in Bloomington, Indiana was exposed for agreeing to help cover up the alleged sexual abuse of a minor in an undercover sting.
In another case in Ohio, Planned Parenthood faced a lawsuit after it failed to report the statutory rape of a 14-year-old girl. The girls soccer coach got her pregnant and then took her to the abortion clinic to cover up his crime, LifeNews reported.
Serrin Foster, president of Feminists for Life, previously has spoken about how parental involvement laws help protect vulnerable young girls from abuses.
Who takes under-aged, pregnant girls across state lines for abortion? Most often, its noncustodial, older men who are sexual predators seeking to conceal the crime of statutory rape or other noncustodial adults involved in sex trafficking of minors, she wrote at LifeNews in 2012.
Foster pointed to the testimony of abortionist Bruce Lucero who wrote in the New York Times: a parents input is the best guarantee that a teenager will make a decision that is correct for herbe it abortion, adoption or keeping the baby. And it helps guarantee that if a teenager chooses an abortion, she will receive appropriate medical care.
However, Planned Parenthood, NARAL and other abortion advocacy groups often lobby against parental involvement laws. They believe that underage girls should be able to abort their unborn babies in a dangerous surgical or drug-induced abortion procedure without their parents knowledge or consent.
In 2013, Planned Parenthood also filed a lawsuit in Montana to overturn its parental involvement requirements.
Supreme Court, here we come!
this judge needs to be dis-barred forever. AS an object lesson to other would-be lawyers and those who teach them, destroy the law school this idiot graduated from permanently as well.
Wow, it’s late and I am channeling Machiavelli big time, but that is what needs to be done
We had a 15 year old foster child, female, who we suspected might be pregnant based on seeing a planned parenthood phone number scrawled on her notepad. We confronted her and she sincerely denied it and said it was for a friend getting birth control. Still, I knew the boy and I spoke with his father and told him to speak with his son. Sure enough, she was pregnant. She was scheduled for an abortion in only two days (California doesn’t require parental notification) and she had denied it as she didn’t want us to find out.
I asked her, now that we knew, what she really wanted to do about the pregnancy, hoping that she would give the right answer and she did. She said that she really wanted to keep it. We told her that we would make that work.
That was fifteen years ago. We later adopted the foster girl and that child is now my oldest grandson. Because he spent seven of his first ten years living under my roof, he is like the son I didn’t have. He gets his driving permit this year. I am so proud of both him and his mother.
FUBO courts. Someone is going to have to bleed in those courts for pimping kids that way from families.
In a real world this judge would be prosecuted for aiding pedophiles, debauchery of minors and highjacking operation of minors on a grand scale
A panel of ghouls. An obscene and evil ruling.
I use to get letters from my daughters school telling me my daughters could go to a judge without my knowledge to obtain an abortion and I would be financially responsible
You know what, why should anyone care? This country is at the point where the two sides cannot reconcile their differences. Lots say that we should all put down our smartphones and talk to our neighbors because we’ll probably find that there aren’t too many differences. That might be the case. Maybe.
But I can guarantee that if I took anyone on this site to certain parts of the Atlanta metro area and broached this topic, the tone of the conversation would go from indifference to rabid Leftist. Indifference in the sense that some on the Left would shrug their shoulders and give a lame response about it not being their business, the girl has her rights but they would want to know if it was their daughter. They would shrug their shoulders at a teenager being given an surgical procedure because they ignore the potential risks due to their indifference.
Then, of course, you’d encounter the insane, rabid Leftist that could potentially attack you and then blame it on their hysteria caused by them being triggered.
That being said, just forget about anything. Break the country up, into 3 parts, and let them the Left have their parts. The rest of us can take our slice and live our lives. While I do think there’s a very good chance of some legitimate violence, leading up to November 2020, I don’t think we’ll ever have a civil war, like we did the last time. Hell, there’s been a civil war in this country since the late 50s/early 60s. It’s been bubbling along, getting worse and worse and now seems to really be manifesting itself since the last administration, basically signing off on all their increasingly aggressive tactics.
It’s time we all come to realize this and make a decision. None of us are going to go into liberal neighborhoods and indiscriminately do violence on anyone. We’re better than that. Will the Left? Absolutely. Hell, they did it to the Senate Majority leader. It wouldn’t have taken much for someone to rile that group up and lead them to do something. That’s when it’ll get ugly. When they bring it to your doorstep.
The Blue states are going to continue to get Bluer. The Red states are being invaded and infiltrated by liberal retirees and workers, along with illegals, to turn those states Blue as well, and the liberals seem to be doing a pretty good at that.
There is one thing that could change all of this, IMHO, but it would be pretty much impossible, even though it’s probably what most of us would like.
IMMIGRATION....end all of it...every single bit of it....end every and any refugee program there is and return each and everyone of them to their country of record....end every and any asylum program there is.....go back 25 years and rescind any citizenship that was given to anyone based on Birthright Citizenship, Green Card loopholes, H1B/H2B visa programs....incrementally cut EVERY benefit that ALL of the aforementioned receive....there will be some exclusions to all of this like: they did it the right way, they served in the military, made it through the system and went into public service(cop, fireman, emt, nurse, doctor)...basically they are a functioning and contributing member of society, however, any family members on the dole start packing....THEN, when all of that is done and the dust settles, we can finally take stock of where were are as a country and who is who.....Outside of a complete housecleaning, it’s only going to get worse.
Either that or every state in the country just starts ignoring the biased and partisan decrees from the corrupted federal courts. Just like how the Blue states ignore federal law, every day.
that is a wonderful, wonderful story....I love happy endings.
Eyes getting teary. God Bless you.
Thanks for the GREAT post!
(tears in eyes)
Facts be damned, they will stand by baby-killing, no matter what! (But don NOT give any aspirin without parental consent.)
Planned Parenthood is pro-rape and has been caught on tape coaching girls to lie so police don’t have to be brought in to investigate cases of statutory rape or rape rape.
Very good work and congratulations on your family.
two words, malpractice lawsuit when a girl inevitably has a botched abortion at a “legal” and “safe” abortionist.
Minors cannot consent to such procedure because of the medical risks.
I guess that makes the child a ward of the State and parents are absolved of all support obligations...

Hm?.....Parents are too dumb to know how to use a school voucher wisely but a 13 year old is smart enough to find a competent surgeon and manage any post-surgical complications.
Yeah! I get it. /s
