Yes, but the courts have ruled that chord progressions can't be copyrighted...it'd be like copyrighting the word "and." MELODY can be copyrighted.
Yes, I agree the melody in the two songs isn't exactly the same. But that isn't the point. If I launched a publication called "Breader's Digest" I'd likely be sued...it isn't enough to say "well, it's not EXACTLY 'Reader's Digest'....". That's as lame as Vanilla Ice's explanation of how he didn't rip off Queen and David Bowie.
