Trump Can’t Block Users on Twitter, Appeals Court Rules

The 2nd Circuit Court of Appeals ruled on July 9 that President Donald Trump violated the First Amendment when he blocked users from viewing and commenting on his Twitter messages. The court determined that Trump’s Twitter account is an official rather than a personal account, making his use of Twitter’s blocking feature akin to a government official excluding people he or she doesn’t agree with from a public forum. Trump’s attorneys argued that his Twitter account is a personal one. The court wasn’t convinced, writing in the opinion that the account’s landing page bears “all the trappings of an official state‐run account.”

Hmmm ... Trump can’t block folks on his personal Twitter account but Twitter can block/suspend/terminate folks willy-nilly.

The Court is right. He uses it as part of his government office. Citizens have a right to redress. This one is an easy call.

But if you go to the court’s website, there is no way to personally respond to the judges. All of the contact information is generic.

Yes it is such an easy call. Citizens should have the right to approach Trump at anytime no matter where he is in order to express there free speech. /sarc

Of course it does not matter that they can always express their views all over twitter unless they are conservative.

And if Trump should post here on FR then Jim would have to let every liberal on the face of the earth register and comment at will.

Hmm This goes both ways. If the account is ruled government, the Twitter should be susceptible to first amendment complaints.

It does not apply to any of them unless someone starts and wins a lawsuit against each and everyone of them in order to make them comply(after an individual can prove that they were personally disenfranchised and have standing). And then it would only take a few years(And a million dollars) for a determination to be made. That is the beauty of our court system. And the taxpayers would be paying for AOC’s defense.

Sure. He didn't deny them anything. The can seek redress by sending a letter or an email.

Trump should ignore it.

Was the complaint by Trump the fact that Twitter is cutting off supporters and only allowing those opposed to respond ?

Guarantee that Zerobama or any other Demonrat can block or ban anyone they want. It’s just because it’s TRUMP that they ruled this. Weaponized judiciary. They know TRUMP has MILLIONS of followers on Twitter, and they want to try ANYTHING they can to silence him. TRUMP is more effective on Twitter in communicating with the American people than any President in history, using any means of communication.
