Was Nellie CIA?
Did she know Brennan?
Was she possibly the Brennan/CIA conduit to both Fusion/Steele and the DoJ?
If Nellie is CIA, then prosecuting her could be problematical ... yet essential for getting to Brennan and his superiors.

A lot of people who *think* they are setting Trump up and were spying on him and getting away with it are about to find out the hard way who they’ve messing with.

Trump knew what a canary trap was before I was born. He’s used them many times.

I am assuming that any civilian trial of a CIA officer will be highly encumbered by claims the activities were:

1) classified
2) authorized
3) need to know
4) evidence can't be located
5) witnesses are missing from the country
6) didn't happen

So ... maybe that's where the military justice system kicks in which was discussed in the K. confirmation hearings.
