If there is a 2nd mortgage it will be recorded at the clerk of court for the county where the property is located. There will also be record of any satisfaction of mortgage. That would be the place to start.

...they used the money from it to pay off the pre-existing mortgage...they should have received some sort of notification from the lender that they had satisfied that mortgage - even a copy of the mortgage itself marked satisfied - hopefully they kept it, or can locate it, to show to the bank to prove they completed payment......

2004? You are lucky the lender is still around. A lawsuit against the lenders would at least get their legal department to start contacting the business folks. Short of that, a complaint to the primary regulator, and a Congressional inquiry can sometimes help the bank focus on an issue.
