Not a lawyer but I suspect they are exceeding the authority of a City Council. At minimum it is the State that regulates birth certificates (and ultimately the Federal Government)
Try getting a passport with out gender being clear.
I will predict that at some point in time when sanity prevails we will go back to there only being two genders
