Biker indicted on charges from 2015 Twin Peaks shooting asks for new attorney (Waco)

A biker who was indicted on murder charges over the 2015 Twin Peaks shootout asked for a new lawyer on Monday.

Tom Mendez, a defendant, told court officials that he would like to change his lawyer in the Twin Peaks trial.

The judge and the prosecuting lawyers were not happy about these developments, however, after they presented more evidence against Mendez he said it had to be done.

The judge has authorized that another attorney is added to the defense, but will not withdraw the sitting attorney from the trial.

Jaime Pena is the attorney Mendez requested after prosecutors develop more evidence against him.

Attorneys are waiting to find out whether the continuance will be granted in this case, but if it is not the trial will remain on its original date.

The judge is set to determine whether or not he will authorize the continuance at 8 a.m. on Thursday.

This whole thing smells.

The police were there with cameras filming the whole place.

Did they knew in advance something was going to happen? Or did they make it happen?

I find it hard to believe that TXDPS was involved in a setup. It creeps me out just thinking about it.

It was a public gathering of a bunch of criminal gangs, in another gang’s territory that they were at war with.

It would be kind of remiss of the police if they weren’t there filming. I mean, most gangs aren’t stupid enough to publicly announce when they are going to do stunts like that, but when they do, I would expect the police to show up and be prepared.

The police arranged for the Cossacks to show up at the meeting. They had not attended in the past.

The meeting had not been held right in the heart of their territory in the past. It was obviously a direct challenge to them, and they answered it.

Also, it’s not true that they had never attended the meetings. They had, before the whole dispute over the Bandidos’ affiliate clubs not being charged dues arose, and then they and their affiliate clubs decided not to pay either, which is when they were kicked out.

There was an article here some time ago that discussed the police having their Cossack CI/undercover purposely attend the meeting. It was a deliberate provocation orchestrated by law enforcement. Funny thing was, it was largely Cossacks who were killed by police.

The Cossacks were already planning on attending. The CI wasn’t running the Cossacks, he couldn’t make them go where they weren’t already going to go.

The questions asked and answered conform with the motion to reveal the identities of undercover officers and confidential informants entered in the case against Matthew Alan Clendennen, a member of a Cossacks support Club, the Scimitars, who is a local lawn service operator employing a crew of less than a dozen men who keep numerous central Texas commercial locations in trim.

The thrust of that legal maneuver is to discover why and how the police got the intelligence that there would be violence at a Council of Clubs and Independents meeting if it were to be held at the Twin Peaks Restaurant that particular Sunday, against the wishes of police and state agents in cooperation with federal authorities investigating an ongoing “declared war” between Cossacks and Bandidos.

--According to confidential sources, “Big O” Reeves and a former Waco Drug Enforcement Unit Sgt., Jason Barnum, were in attendance, and their presence was noted by many in the crowd whom they made uncomfortable in one way or another. “Barnum was the one causing trouble the previous bike night with Big O. That information is from those that know but won’t come forward,” one of our sources said.

Asked who said that, he replied, “The waitresses.”

On Bike Night April 16, Barnum and Big O were riding partners. “Barnum would get Big O worked up. The witnesses that are too scared of being killed by cops are the waitresses.”

On May 17, a Waco police officer wielding a rifle reportedly aimed it at their heads as he shouted they had to give up their phones and get on the ground – or he would shoot them dead.

Sgt. Barnum would later pound a doctor from Providence Hospital in the face at high noon on June 29 due to his alleged attentions to Mrs. Barnum. Waco Police suspended the 16-year veteran of the force on September 10 – indefinitely – and later fired him on September 23. He appealed that decision through the Combined Law Enforcement Association of Texas and lost on March 16.

I may have read that, it is familiar. And I remember thing it tied in with info in that article that had something about yellow helmet and guns in a saddle bag in the title. The police definitely egged it on.

A biker with a “big yellow helmet” who appeared to be in charge pulled out a “long, ‘Dirty Harry’-type pistol” and fired the first shot in the May 2015 Twin Peaks biker brawl, a former Twin Peaks employee testified Tuesday.

While testimony thus far has not revealed who was wearing the “big yellow helmet,” previous video and photographic evidence presented by the state show Jacob Carrizal leading a band of Bandidos into Twin Peaks while riding a shiny blue motorcycle and wearing a yellow helmet.

Jake Carrizal had a derringer.

That’s the article I was thinking of, at the end it talks about the police urging the Cossacks to attend the meeting to “try and make peace”.

Judge grants defense request to postpone Twin Peaks trial

A judge granted a defense request Thursday to postpone the next Twin Peaks trial, bumping a priority setting for the trial of former Baylor University defensive end Shawn Oakman.

Judge Ralph Strother of Waco's 19th State District Court reluctantly granted the motion from attorneys for biker Tom Modesto Mendez, who said they could not be ready to try the case by the scheduled Aug. 27 trial date.

Strother, who said he was trying to be fair to both sides, said a jury panel of 600 potential jurors for Mendez's case will come in Friday to fill out juror questionnaires and to be given instructions from the court.

Strother excused Metzger from Friday's court appearance after Metzger said his 98-year-old grandmother is "on her death bed."

Moving Mendez's trial to Sept. 10 knocked Oakman's sexual assault trial from its scheduled slot. Moody said he and Oakman's attorney, Alan Bennett, will confer soon and find another trial setting.
