The article seems to imply that it is, which would mean he was out on bail.

Former NFL tight end Kellen Winslow Jr. was reportedly arrested in San Diego on Thursday and is facing nine charges, including kidnapping with intent to commit rape and forcible rape.
He was just arrested a week ago for burglary. This guy is the son of Hall of Fame tight end Kellen Winslow, who played for the Air Coryell San Diego Chargers when I was a kid. He's grown up with every advantage, he himself was an NFL player (though never nearly as good as his father) - and he does this in the city in which his father became famous. What a disgrace.

He is not even worthy to play on any team except the end of a fudge packing line.

I recall right after he signed his first contract, he bought a motorcycle and took it to a vacant parking lot to lean how to ride it. Well, he crashed it and hurt himself in the processes and missed the entire season. He was never the same after that.
