Please sign the WH petition below calling for President Trump to sign an Executive Order requiring mandatory use of the E-Verify system for all employers in our country.

No job and many criminal invaders will self-deport. We won't have to find them.

Please sign and also pass this on. If we get 100,000 signatures the petition is formally presented to our President. He has grabbed on to movements before and it would be great if he saw this and it became a priority with him.

E-Verify is a voluntary program for most employers, but mandatory for some, such as employers with federal contracts or subcontracts that contain the Federal Acquisition Regulation (FAR) E-Verify clause and employers in certain states that have legislation that mandates the use of E-Verify for some or all employers.

Why don't we pass a law that limits EOs to guidance for carrying out laws on the books and OPM issues?

Sorry, but this is an issue for Congress, not for an EO.

Wait... If the President can just do this by executive order, why hasn’t he done so already?

Don’t tell me he’s waiting for Congress to make ut the law. He’ll be waiting until the end of his term.

No, if he has the authority to do this on his own, he should just do so, without us having to beg him.

True, but Congress is slow and cowardly. We've got to 'turn the magnet off', and dis-incentivize the forty million invaders who are already here.

Do the EO now, then push Congress to make it the law.

Executive Orders create policy for enforcing existing laws.

Is there actually an existing law that permits universal E-Verify?

I don't even know what legislation authorizes the limited E-Verify we have now.

I'm going to spend some time on Google Scholar and track down the original legislation.

I’ve worked as a government contractor
for a number of years. The I-9 form is
the main form used by employers (it’s
use is mandatory) to verify a prospective
employees citizenship, and that he/she
is qualified to work in the USA. E-verify
is used as a backup to the I-9 form, to
reinforce a prospective employees
eligibility. The I-9 form has been in
use since 1986. It is the employers
responsibility to verify. Therein lies
the problem, as employer’s “look the
way” when it comes to their bottom line.
Sad to say, but signing your petition
won’t do any good until employers are
held responsible for whom they hire.

Can Universal E-Verify be mandated by Executive Order?

In my opinion - Yes

Legislative Origin of E-Verify...

E-Verify is an Executive law enforcement policy derived from the Immigration Reform and Control Act (IRCA) of 1986.

IRCA requires all employers to file a Form I-9 for every employee. Under penalty of perjury, I-9 requires every employee to show valid ID and to swear that they are legally authorized to work in the USA.

In 1997, E-Verify was one of several new programs that were tested to verify the information on Form I-9.

In 2007, the Department of Homeland Security mandated that all federal contractors and vendors must use E-Verify.

Such a mandate from DHS would have to come in an Executive Order from the President, or the Attorney General, or the DHS Secretary.

As of 2016, 23 states use some level of E-Verify for in-state employees.

At least four states mandate E-Verify for all gainful employment.

Bottom Line...

Since the IRCA mandate for Form I-9 is national in scope, I see no reason why Trump cannot mandate E-Verify for every Form I-9 in the country.

However, the vote total did not change.

In fact, the vote total has not changed for the last 10 minutes.

Half the illegal immigrants in the USA arrived here legally, usually with a tourist or student visa.

When the visa expires, they just stay here.

Also, the border jumpers have two time honored strategies for staying in the USA.

(1) They can claim a “credible fear” of being deported to their home country. 95% of those people get a court date for an Asylum hearing, and then they are released.

(2) Or, “Catch and Release.” 75% of border jumpers are issued a misdemeanor citation and given a court date. Then they are released.

We would have to build detention facilities for at least one million border jumpers if we did not release them.

Bottom Line - “Jobs” are the great magnet. Stop the illegal jobs with E-Verify and civil lawsuits, and you will stop illegal immigrants.
