They are following a stupid congressional “rule” which would be easy to change. But I think it’s a stretch to call it unconstitutional.

If children could die from a federal shutdown, why would McConnell stick with a 60 vote requirement?

It’s unconstitutional in any definition. 60 votes is not mentioned in the Constitution.

Its unconstitutional in the sense that the Constitution does not provide for it and blocking legislation authorized by the constitution via an artificial requirement to pass laws in contravention of Art I makes it unconstitutional. Ann is quite right.
