The brewery announced the 10th release of its Utopias, a limited release, extreme barrel-aged craft beer. The brew is 28% ABV, uncarbonated and described by Sam Adams as reminiscent of a rich vintage Port, old Cognac, or fine Sherry with notes of dark fruit, subtle sweetness, and a deep rich malty smoothness.

It is not law that caps the definition of beer - it is the fermentation process.
Both beer and wine are made by yeast fermenting sugar. (I've homemade both.) In every case, as the alcohol level in the batch rises it reach a level(depending mainly on the strain of yeast and temperature) that kills the yeast and you can't get the beer or wine any stronger. That level is never very high - anywhere from single digits to 14-15%.
To take the batch beyond that, to a higher alcohol content, you must distill or fortify it something other than true beer or wine. (Examples: brandies, ports, sherries, liquors,etc.)
I hear ya. There are so many businesses I have stopped buying from, over the years, I have forgotten which ones they are supposed to be.

there are so many different beers today it hard to immagine that you could not find a beer that appealed to your taste.
In my senior years, I’ve pretty much turned into a teetotaler. :(

Haven’t had any for 29+ years - as I recall, the first one or two on a hot day weren’t bad then it tasted like tainted water.

Exactly - was 18 when it came out and had to try it but one 6-pak was enough.
The BrewDog guys in Aberdeen only made the stuff to annoy the EU regulators, who were aghast at the craft brewer's previous high-octane brew (Tokyo Stout), which was only around 17% ABV. That one sounds more enjoyable, but it seriously crossed some lines of propriety in the UK. Who knows, maybe the single-malt distillers were worried at the trend.
IIRC, BrewDog in Scotland used a freezing process to force water out of the brew and raise the ABV. I suppose that's a type of distilling.
