Would you prefer that the accused had inadequate counsel?
I respectfully disagree for two reasons:
1. Similar to a doctor, an attorney’s first common sense duty to his client is “to do no further harm”. If the lawyer pisses off the jury pool for no “really good” reason, he has arguably harmed his client and arguably committed mal practice.
2. One interpretation of this lawyer’s inappropriate, ill timed suggestion could be by some........... “hold on, she was on ambien, he had a right to shoot her”.
