A high school student who stabbed a fellow pupil in the neck with a pencil can't be expelled under her school district's weapons policy, a Commonwealth Court panel has ruled.
In fact, Judge Patricia A. McCullough wrote in the state court's opinion, every Pennsylvania classroom would be empty if her court agreed with the Pittsburgh Public School District that a sharpened pencil is a prohibited weapon.
The case revolves around what happened between the 10th grader and another student at the Barack Obama International Academy on May 9, 2016.

Should have been expelled for the ASSAULT... with or without the pencil being identified as a “weapon”... stupid courts
But of course; I mean, it’s not as if the young lady pointed a finger and said “bang,” or improvised a facsimile assault weapon out of a slice of bread, or brought an aspirin to school. All she did was stab another kid in the neck. Keep it in perspective, folks.
I knew a math teacher that had a problem being constipated....

As an aside, I was stabbed with a pencil by a kid in school. I still carry a chunk of the lead under my skin. I didn’t care if they expelled him as I got my revenge by beating him to a bloody pulp. They didn’t expel me but they did suspend me (and not him).
My hubby went to that high school when it was named Peabody High. He was beyond belief when he found out it was named after B. Hussein O.

I used a credit card to disable a mugger. It wasn’t a weapon but it damn sure stopped the mugging.
I think you and I are the only ones who’ve actually seen that movie...

My daughter stabbed a bully in school in the 6th grade in the leg. They are taught to “Walk, and talk” - walk away and talk to a teacher. She was walking and he kept pestering her. So she started walking towards the principal’s office and he kept after her.
“And then I saw the pencil on the floor - it just happened so suddenly. I reached down and swung around and got him in the leg.”
The bully made it to the principal’s office first, crying and bleeding the whole way.
We were brought down to talk with our daughter and the principal. The principal knows us and our daughter who is very sweet. “He must have REALLY been bugging you for you to do that!” (He was a known bully.) My daughter was “suspended” for the last hour of the day as the principal said she had to do something. We told the principal we would be going out for ice cream. “That sounds like a good idea!”
I had the same thought: A pencil isn’t a weapon; but a Pop-Tart is a gun. Do we even wonder why our schools are failing?
