Then again, I’ve seen a whole lot of idiocy over the years, his story could completely be on the up and up and I’d still view it as a double homicide. If he had the slightest thought that she might still be alive and did not call for medical aide, well, that’s depraved indifference in my book if everything else about his story completely checks out.

The act of retreating and ordering the other party away is an attempt to regain innocence in the use of force. There’s nothing to defend against at that point for you. Your choice is stay back or launch a new assault.
