In California, CPC section 195 makes it a misdemeanor to hide one’s face to either flee from arrest or conceal one’s identity during the commission of a crime. It’s usually tacked on to something like a liquor store robbery if the mook wears a mask.
In this case, we have an underlying felony, assault with a deadly weapon other than a gun, which is PC 245 (a) (1).
There is additional video of this same man attacking at least four other people at that same riot, using the same bike lock.
So, we have at least 4 felony assaults and the misdemeanor 195, and possible conspiracy charges since it should be easy to show that he and Felarca were working closely during this melee. (Plenty of video shows them standing next to each other during, and pior to the fracas.)
If the PD’s dectectives won’t investigate, one hopes that the Alameda county DA will detail some of her DA investigators, who are also sworn LEO’s to dig into this a bit.
This could easily be a three strikes caper for Mr. Clanton, but I’d bet that even if charged, he’ll be offered a plea deal to a misdemeanor battery. Still, would be nice to see some justice done here.
He also has two prior convictions based on screenshot posted of personnel records on 4chan; don’t know what they were for, but if they were similar pleas to simple assault or battery he may not be offered a plea this time. He also bought 14 bike locks for next day delivery just before the event, based on 4chan hacked screenshot of his Amazon account, indicating premeditation.
