There are a lot of frivolous lawsuits in America, but this won’t be one of them.
Sorry, Laz, but he was asked multiple times to vacate the a/c, as is the right of the airline. He chose to not comply. He was the one who required the LEOs to remove him in that way. Had he simply followed the legal direction of the airline personnel, none of the events that followed would have happened.
Just because you do not agree with the decision of a common carrier, just like disagreeing with the decision of government, that does not allow you to ignore that decision.
Actually, as in this case, you can ignore such a decision, just like people did in the Whisky Rebellion and the Civil War, but then you are responsible for the aftermath of that refusal.
When I was going home on leave after a deployment many years ago, they said they were going to do the same thing if nobody volunteered. As they walked down the aisle, I remember grimly holding onto the arm rests, thinking “If they tell me I have to get off, they are going to have to pry me out of my seat!”
I would have done it. I remember a Connecticut State Trooper hooking a tow truck up to my car (If I had returned one minute later, my car would have been gone!) and I threatened to lay down in the road in front of the car. I would have done it, too, I was so frikking hopping mad. (I had a tow truck of my own that arrived about a minute after I began arguing with the trooper.
The trooper did change his voice and posture while saying “Calm down, sir, lower your voice, and stop swearing.” which I recognized as a prelude to something like disturbing the peace or whatever, but...didn’t get my car towed.
