Not necessarily. The government’s initial request for an intelligence warrant was denied, but a second one was granted after being narrowed and focused, probably with new claims and facts added to justify concern and suspicion. Although the FISA court has been criticized for rarely denying search warrant applications, the same is true with other courts in regard to criminal and civil search warrants. These days, police, prosecutors, and judges are well-acquainted with the controlling legal principles, which have been made more definite in application by thousands of reported case law decisions in recent years.
