Question about Presidential Pardons

Posted on 10/26/2016 7:36:26 PM PDT by gitmo

Question: Can the President pardon someone for a crime they have not been arrested for?

Can the President pardon someone for a crime they have not been convicted for?

Should I have ended these sentences with prepositions?

Yes. Nixon was pardoned though he’d never been charged with any crimes.

Obama might pardon Hillary et al on the way out of office.

The real questions is whether Obama can pardon someone for crimes he is also part of (obstruction of justice, e.g.)?

The President can pardon anyone he want, for any reason.

The only way he can be stopped is to be removed from office. But until then, nothing can stop him.

You should remember to always split infinitives and end with prepositions, no matter what your post s about.

If I knew how to dangle a participle, I’d have done that too. For all I know, I did.

True and in spades.

I do NOT think that a president, NOT ANY PRESIDENT, can pardon himself, though.

Probably not.

Question: Can the President pardon someone for a crime for which they have not been arrested?

Can the President pardon someone for a crime for which they have not been convicted?

Hard to believe the founders never envisioned a crooked president.

Yes, but if the best happens, obama is a big enough asshole to let Hillary twist in the wind.

“Question: Can the President pardon someone for a crime they have not been arrested for?”

**for which they have not been arrested?**

“Can the President pardon someone for a crime they have not been convicted for?”

**for which they have not been convicted?**

“Should I have ended these sentences with prepositions?”

NO! Shape up or ship out!

What is the legal basis for a presidential pardon, and can the courts overturn or ignore one?

He knows if she goes down, he (and all of DC) will go down. He will pardon her.

Although it may not be constitutional, he may well pardon himself. Why not? No one stopped him with Ocare or his EO’s or any other dictates. With the DOJ, FBI, and SC in his pocket, with the Commies being above the law, who is to stop him? President Trump? We shall see.

I would certainly argue that even the explicitly enumerated powers granted to the President by the Constitution are not unlimited or absolute and should be subject to review by the courts and/or subsequent presidents.

If Obama (or any other President) was to pardon either himself or others (i.e. the Clintons) in a way that grotesquely violated the precedent of past president’s behavior with respect to pardons I would argue that Trump could rescind such a pardon.

I reject the idea that we are bound by any public official’s actions that are the result of bribery or other criminal actions.

Personally, if that makes him an A-hole then I guess I am one as well because I would take a good deal of pleasure in her misery

Pardons are only for federal crimes. I am certain if it is decided to go after Hillary a state violation can be found. Likely though she will skate.

Depends if she resists arrest and appears to have a life-threatening device aimed at them as they are arresting her.
