Canadian Pacific Railroad filed an appeal Tuesday with the United States Seventh Circuit Court of Appeals seeking an injunction to stop Illinois Route 390, also known as the Elgin O’Hare West Access (EOWA) project, from taking land in the Bensenville Rail Yard it operates in Bensenville and Franklin Park...

The case sought a permanent injunction to stop the tollway from using eminent domain to take the land and make way for parts of the new tollway. The case was dismissed in March.

The Illinois Tollway is a particularly greedy bunch of a-holes. Everything is big bucks, their pensions, vacations, expenses...the office table was mega bucks... http://articles.chicagotribune.com/2004-05-11/news/0405110235_1_toll-authority-helicopter-aircraft

The 30 year bonds were to be paid off and no more tolls, around 1990... Surprise, surprise! Maintenance is so high we had to issue more bonds AND raise tolls!!! NO FREEWAY FOR YOU!

I agree with you about the toll authority. Unfortunately I have found CN to be an equally a-holey company so for me this is like attending a sporting event where your greatest regret is that both sides cannot lose.

In some states, railroads have eminent domain authority. Perhaps the railroad should cut a line across the toll road and put up crossing gates, running switch engines back and forth at rush hour.

Is this part of the old Illinois Central line, or the old GM&O line?

Never mind. I see this is CP, not CN.

Hunter Harrison was in charge of CN for a while and is now in charge of CP. While they are different companies, CP now has many of the same people that were in charge at CN.

No, it's part of the Milwaukee Railroad.
