DBCJR, the magazine seems to have gotten close, but cited the wrong law. Comey appears to have ignored the law, 18 USC 193 Subsection F, which applies to government officials and defense related documents. Comey admits that there were some classified documents found among those transmitted through Hillary’s server, and there is no intent required for her conviction. In fact “intent” is nowhere included in the law, rather like manslaughter does not require proof of intent. Having responsibility for sensitive and defense-related documents which are exposed, accidently or not, guarantees conviction of any official satisfying the criteria, criteria which Comey himself admits pertains to Hillary. Comey lied and counts on our ignorance, along with the complicity of people we assume to know the law like Trey Gowdy. Congress could and should impeach Comey. Hillary’s violation of 18 USC 793 makes her explicitly ineligible to hold government offices.
For a refreshingly clear explanation of the case by an experienced prosecutor, though one who doesn’t tolerate liars and fools, listen to “Deconstructing Comey and the FBI”, one of Krisanne Hall’s daily discussions of the law. Don’t be misled by the informal language, Krisanne was a formidable prosecutor, along with Russion Intelligence specialist and biochemist before taking on her public mission to teach the original intent of the Constitution to whomever is really interested. (She does say 18 USC 193, but probably misread her notes. She reads and correctly interprets 18 USC 793 (f)). Her reasoning is impeccable.
