No it should not. The Bill of Rights protects us from the government and was never intended to prohibit employers from setting rules and standards for their employees.

Now, do you want the government dictating to private companies the standards they set for employees?

Oh, but they already have. It's called state human rights commissions. Whereby the government can now set standards on the speech of private entities in order for them to participate in the public square.

Unless you feel that is a vested state interest on par with health and safety codes.

And while we're all standing around being good little libertarians and talking about how the first amendment doesn't apply to private entities the entire tyrannical network has grown around us. But you keep on holding on to that little technicality nugget. I hope it keeps you warm at night.

Ahh! But the government does dictate to private companies the standards they set for employees. i.e. the minimum wage, for example. Also, the I-9 that everyone has to fill out. All the employment laws, as well.

So government does dictate to the private employer. Woe be to those who don't comply with those dictates.

Have you ever had any dealing with Labor and Industries? You will see, as an employer just how little rights you have.
