Not so fast....why pay a lawyer to get involved in this? The broker made a mistake, they'll reverse the transaction(s) and in doing so, it cancels out any tax reporting and makes the account whole again....as of the date the erroneous transaction(s) took place - as if it never happened.
While this obviously is a big deal to Homer1, behind the scenes, it's not a big deal. It'll be fixed, no problems.
