A man involved in the collision that killed longtime Oklahoma sportscaster Bob Barry Jr. was returned to Mexico three times, a representative from U.S. Immigration and Customs Enforcement confirmed Wednesday.
Gustavo Castillo Gutierrez, 26, of Bethany, was “voluntarily returned” to Mexico twice in 2010 and once in 2013, a representative from U.S. Immigration and Customs Enforcement wrote in an email.
The agency placed a detainer with Oklahoma County on Gutierrez following his arrest Saturday. Guiterrez remained in the Oklahoma County jail Wednesday evening.
Police arrested Gutierrez on a manslaughter complaint, but prosecutors said the facts didn’t support that charge. He was charged Tuesday with a felony driving offense with a maximum punishment of five years in prison, as well as with a felony cocaine offense with a maximum prison sentence of 10 years.
If convicted, Gutierrez will serve time in Oklahoma on the charges, after which U.S. Immigration and Customs Enforcement will decide whether or not to take him into custody and remove him from the country, ICE spokesman Carl Rusnok said.
“After ICE is informed that an alien is being released from local custody in response to an ICE detainer, ICE will determine if that alien falls within our enforcement priorities,” he said in an emailed response.
The accident happened shortly after 4 p.m. Saturday in the 14300 block of N May Avenue in northwest Oklahoma City. Barry and Guiterrez both were traveling southbound when Guiterrez made an illegal U-turn, crossing both lanes. Barry, who was driving a motor scooter, collided with Guiterrez’s Chevorlet Impala. Barry, who was not wearing a helmet, died at a hospital.

The southern border has become a revolving door for every sociopath, scofflaw, and derelict that Mexico wants to send our way.
I would not listen to their pleas that those convicted here in the US for some crime (many of them capital offenses) be sent back to Mexico to serve their sentences, because about a day after they are repatriated to Mexico, they are freed, because they have committed no offenses in Mexico.
The French exiled their undesirables to Elba. Today, it would not be a very good prison, because it has become far too touristy, and the British Navy no longer maintains a patrol surrounding the island, reducing the potential for escape.
But we definitely need an off-shore detention facility for these recidivists and repeat offenders. Even if it becomes extremely crowded after while.
