TOTAL Theft and plagiarism, IMHO.

And I am a songwriter. I struggle with every song I write to make sure that I didn’t somehow hear the melody somewhere.

Is it similar? Sure. But I don’t buy the plagiarism ruling. Might as well say anything with a beat and falsetto singing like Prince’s “Kiss” or “Emotional Rescue” by The Rolling Stones are, too.

I grew up on the Marvin Gaye song and just heard a minute ago on Youtube the Thicke song.

It has the same "sound" - not sure how to describe it other than sound effects and "feel" - but it is not the same melody.

It is definitely not Gaye.

John Fogerty got sued for plagiarizing his own song! After awhile they did all start to sound the same.

I am a big fan of the Russian Classical composer Sergei Rachmaninoff. Eric Carmen used the melodies from two of Rachmaninoff’s most famous pieces. “All By Myself” used the 2nd movement from Rachmaninoff’s 2nd Piano Concerto and “Never Gonna Fall in Love Again” used the theme from the adagio movement of Rachmaninoff’s 2nd Symphony. Carmen had training in Classical music. He thought the pieces were in the public domain but they were not and the Rachmaninoff estate sued Eric. He ended up writing a check.
