Amendment would Constitutionally Protect Alabama from Foreign law
Hundreds of court cases in the US have used Sharia Law in their judgements. This election day, voters in Alabama will have the chance to approve a constitutional amendment that protects the freedoms of the people of Alabama and even foreigners residing there by prohibiting the application of foreign law in Alabama courts. Act for America
State Amendment 1 - Banning imposition of foreign laws in Alabama
2,444 of 2,469 precincts - 99 percent
x-Yes, 677,916 - 72 percent No, 259,852 - 28 percent
Way to go Alabama!
Until the US Constitution is amended by the states to remove the Federal court’s jurisdiction over matters like this, it is meaningless.
Aint it the truth?
Even if this type Amendment were passed what makes you think the USSC (liberal “Justices”) wouldn’t strike it down as unConstitutional?
I don’t see why any court in the US would even consider using any foreign law in their courts in the first place. The US Constitution is the law of the land period.
Hundreds of court cases in the US have used Sharia Law in their judgements.
I’d like to know of some examples. I understand there may have been some civil cases between Muslims like in MI. But I wasn’t aware there were “hundreds”.
Does it specifically prohibit Sharia law by name?
The Constitution already covers this. All Congress has to do it limit the jurisdiction of the courts. They just don’t do it.
mohammed was a child rapist.
The result of this measure is that businesses will not use Alabama courts in contracts dealing with foreign trade. These measures only highlight people’s ignorance on how our court system works. People seem to confuse the workings of criminal courts with civil courts. Of course religious and foreign law do not have a place in criminal courts, and never have. However, in civil courts, foreign law is used to settle contract disputes in foreign trade issues, and religious law to settle contract disputes between for example Hasidics whose contracts reference religious law.
SCOTUS will say it’s unconstitutional for whatever reason; they’ll find one.
Yes of course Congress can deal with this (but they won’t).
My point was that the States can do so as well using the convention method.
The law is useless (at best) unless it explicitly bans Sharia, and only Sharia. If it doesn't ban Sharia, it's not an anti-Sharia law.
