Well, it won’t be reversible error. It would be malpractice not to bring it up on appeal, so of course it will be there. But there was no jury it affected (sentencing phase) and the sentence is in line with similar cases. So while it will be appealed, the absolute worst that would happen is it would come back for re-sentencing and the Defendant will get the same sentence. In short, this is pretty meaningless from a legal point of view.

I remember when this case first came up. She was his legal caregiver (collecting money for living with him). Police had been called multiple times for her beating on him. His neighbors and family all said he refused to fight back against her.
She literally crushed his skull.
